Spain Asks EU To Evaluate Privacy Concerns Regarding OpenAI's ChatGPT

As scrutiny of artificial intelligence (AI) systems grows worldwide, Spain’s data protection agency has asked the European Union’s privacy watchdog to assess privacy concerns surrounding ChatGPT of OpenAI, the agency told Reuters on Tuesday.

The AEPD’s request was made public at the same time that Italy’s data regulator was reviewing measures suggested by Microsoft Corp-backed OpenAI in response to concerns that had prompted the regulator to temporarily ban the chatbot on March 31 and France’s privacy watchdog CNIL said it was looking into several complaints about ChatGPT. The board of the Italian regulatory body met on Tuesday.

As concerns about AI’s effects on national security and education grow, the Biden administration also stated that it was looking for feedback from the public on potential accountability measures for these systems.

A spokesperson for the organisation said in an email that the AEPD “understands that global processing operations that may have a significant impact on individuals’ rights require coordinated decisions at European level.”

So that unified actions can be carried out within the context of the General Data Protection Regulation’s application, it has asked that the issue of ChatGPT be included in the next plenary of the European Data Protection Committee in the near future.

The European Data Protection Board (EDBP), which is comprised of representatives of national data privacy watchdogs, is scheduled to hold a plenary meeting on April 13th. Whether the ChatGPT topic would be covered at the scheduled meeting this week was not immediately clear.

The EDPB stated it was unable to share meeting information in an email statement to Reuters. Investigations at the national level, which fall under the purview of national data protection authorities, are generally outside the purview of the EDPB, it was stated.

Other privacy regulators in Europe are looking into whether harsher measures are necessary for chatbots and whether to coordinate such actions in light of the Italian regulator’s move.
